Terms of Trade

1. Force Majeure

1.1 Fizzics Education shall not be held liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to:

  • Acts of God, natural disasters, or extreme weather events.
  • Strikes, labour disputes, or industrial actions.
  • Pandemics, epidemics, or public health emergencies.
  • Government restrictions or orders, including lockdowns.
  • Equipment failure, power outages, or transportation disruptions.

1.2 In the event of a force majeure occurrence, Fizzics Education will:

  • Notify the client as soon as practicable.
  • Offer alternative dates for the service, if possible.
  • Provide a refund for any services that cannot be rescheduled.

2. Payment Terms and Refund Policies

2.1 General Payment Information
  • Payments must be made via EFT, cheque, or credit card (Visa and Mastercard accepted). Credit card payments attract a 2% surcharge.
  • International clients may pay through PayPal or by cheque arranged with Fizzics Education’s office.
  • All payments must be accompanied by a remittance for reconciliation.
2.2 School & Preschool Science Visits
  • Full payment is required 7 days prior to the scheduled visit date.
  • Payments not received by this deadline may result in the cancellation of the booking.
2.3 Vacation Care & OOSH Holiday Science Visits
  • Full payment is required prior to the scheduled visit date to secure the booking.
  • Cancellation policy:
    • Cancellations made less than 4 weeks from the booking date will incur a 50% booking fee.
    • Cancellations made less than 2 weeks from the booking date will be invoiced at the full booking rate.
2.4 Children’s Science Parties
  • A deposit is required at the time of booking to confirm the reservation.
  • Full payment via EFT is required prior to the event date. No cash payments will be accepted on the day of the event.
2.5 COVID-19 Affected Events
  • In the event of government restrictions due to COVID-19, Fizzics Education will work with the client to:
    • Postpone and find an alternative date for the event.
    • Offer an online version of the program, where possible.
    • Refund the payment if no alternative can be agreed upon.

3. Client Responsibilities for Science Outreach

The client is responsible for:

  • Providing a safe and suitable environment for the delivery of science outreach services.
  • Obtaining any necessary permits or approvals for events.

4. Consumer Science Products

4.1 Payment Options
  • Payments for consumer science products can be made via PayPal, Afterpay, POLi, or Stripe on the Fizzics Education website.
  • Payments via school purchase orders may be arranged with the office (conditions apply).
  • Split payments using direct credit card incur a 2% surcharge (Visa and Mastercard accepted).
4.2 Domestic Shipping Costs
  • Orders under $100:
    Shipping rates are automatically calculated at checkout (Australia-wide).
  • Orders over $100
    Free shipping (Australia-wide).
  • Express Post:
    • $17 for orders up to $100.
    • $5 for orders over $100.
  • Delivery is typically within 5 business days on the eastern seaboard (NSW, VIC, and QLD). Delivery to WA, NT, TAS, and SA may take 7 to 10 business days.
  • Standard delivery is via Australia Post registered surface mail, though direct courier or airmail may be used depending on the item and arrangement with Fizzics Education.
  • Express Post orders are dispatched within 24 hours if placed on a business day.
4.3 International Shipping Costs
  • International shipping costs are calculated at checkout.
  • Payment through PayPal or Stripe is recommended for international orders.
  • The receiver is responsible for any customs charges or duties imposed by their local government.
  • Delivery times vary based on location and the recipient’s local postal service.
4.4 Contactless Pickup
  • Contactless pickup of orders is available.
  • Customers will be notified of an agreed 60-minute window for collection between 9:30am and 2:30pm on weekdays.
4.5 Client Responsibility for Shipping

The client is responsible for providing accurate delivery addresses and contact details to ensure the successful delivery of goods. Fizzics Education is not liable for delays or losses resulting from incorrect or incomplete information provided by the client.

4.6 Item Availability
  • If an item is out of stock, Fizzics Education will notify the customer with an estimated restock time or offer a refund.
  • Fizzics Education cannot control the availability of third-party supplier items and will issue refunds for discontinued products.
4.7 Pricing and Discounts
  • Fizzics Education reserves the right to alter the cost and availability of products where necessary.
  • Discount codes cannot be used on sale items.
  • Multiple discount codes cannot be applied to a single purchase.

5. Shipping and Seasonal Considerations

5.1 COVID-19 Restrictions
  • During the COVID-19 pandemic, additional precautions and protocols may result in longer shipping times.
5.2 Christmas Holiday Period
  • Express Post is recommended for orders during the Christmas period due to higher demand.
  • Orders placed before 12:00 pm on December 17 are expected to arrive before Christmas in Australian metropolitan areas.
  • The final shipping day before the holiday break is December 17. Orders placed after 12:00 pm on December 21 will be dispatched from January 4.

6. Returns and Refunds Policy

6.1 Delivery of Incorrect Items
  • Items must be returned within 7 days of receipt.
  • Items must be in their original packaging and undamaged.
  • Replacement items will be sent at no additional cost, or a refund will be issued upon receipt of the returned item.
6.2 Purchase of Faulty Items
  • All goods are tested and deemed in working condition before shipment.
  • If a fault occurs, contact Fizzics Education at 1300 856 828.
  • Refunds or exchanges depend on the date of purchase and the nature of the defect.
6.3 Purchase of Incorrect Items
  • Exchanges are available for incorrect purchases; however, additional postage costs will be incurred by the customer.
6.4 Non-Delivery of Items
  • All purchases are sent via registered post with tracking numbers.
  • In the event of non-delivery, Fizzics Education will open an inquiry with Australia Post.
  • Replacement goods will be issued if the item is confirmed lost, though delays may occur during the resourcing process.

7. Indemnity and Limitation of Liability

7.1 The client agrees to indemnify and hold harmless Fizzics Education, its officers, employees, and contractors from and against any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising directly or indirectly from:

  • The client’s breach of any terms outlined in this agreement.
  • Any injury, loss, or damage to persons or property resulting from the delivery of Fizzics Education’s services, except where caused by the gross negligence or willful misconduct of Fizzics Education.
  • The client’s failure to provide a safe and suitable environment for the services.

7.2 Fizzics Education’s liability for any claim is limited to the fees paid for the specific service giving rise to the claim.

8. Governing Law

These terms and conditions are governed by the laws of New South Wales, Australia.

9. Entire Agreement

This agreement constitutes the entire understanding between Fizzics Education and the client regarding the services and products provided and supersedes any prior agreements or representations.

By placing an order or confirming a booking, the client agrees to the above Terms of Trade.
