IMPORTANT, READ CAREFULLY: YOUR USE OF AND ACCESS TO PRODUCTS AND SERVICES OF FIZZICS EDUCATION PTY LTD IS CONDITIONED UPON YOUR COMPLIANCE WITH AND ACCEPTANCE OF THESE TERMS, WHICH INCLUDE YOUR AGREEMENT TO ARBITRATE CLAIMS. PLEASE REVIEW THOROUGHLY BEFORE ACCEPTING. 1. Definitions “You” refers to the individual booking or registering for the online session. “Participant” refers to any child or adult intending to participate in the online session. “Misconduct” includes, but is not limited to, behaviour deemed harmful, dangerous, illicit, violent, distressing, bullying, abusive, or otherwise inappropriate. “Warning” refers to a notification issued verbally by the presenter or through text-based communication such as the chat function. 2. Use of Services and Responsibilities 2.1 Web Conferencing Platforms Fizzics Education will use Zoom Meeting or Zoom Webinar as the preferred web conferencing platform to ensure optimal child safety and program delivery. The platform choice depends on participant numbers and session format. Zoom Meeting: Participants may be visible and audible to the presenter and other participants. Zoom Webinar: Participants will not be visible or audible and will only interact through polls or the Q&A feature. 2.2 Audio/Video Controls Participants may choose to turn their audio and video on or off during Zoom Meetings, but this may limit their interaction during the session. Supervising adults are responsible for protecting participants’ identities by ensuring that no personal information (e.g., last names, phone numbers, home addresses) is publicly broadcast. 2.3 Supervision Requirements Fizzics Education presenters are not substitutes for on-site parental or guardian supervision. The supervising adult is responsible for monitoring the participant’s behaviour during the session. 3. Behavioural Management and Misconduct 3.1 Presenter Authority Presenters have the authority to manage participant misconduct. For minor misconduct, a warning will be issued. For repeated offenses, the presenter may disable the participant’s audio or video input while allowing continued viewing of the session. If misconduct persists, the participant will be removed from the session. In serious cases, the participant’s guardian or relevant authorities may be notified. 3.2 Serious Incidents If serious or concerning content is shared by a participant, Fizzics Education reserves the right to immediately remove the participant and liaise with relevant authorities if necessary. 4. Technical and Service Requirements 4.1 Internet and Platform Requirements Sessions require a reliable internet connection with a minimum speed of 1 Mbps for both upload and download. Fizzics Education is not responsible for service disruptions caused by the participant’s internet service provider, Zoom, or third-party technical issues. 4.2 Third-Party Web Conferencing Platforms If a third-party platform is requested instead of Zoom, the following terms apply: The supervising teacher or adult is responsible for implementing cyber safety measures such as privacy and security settings to prevent uninvited access or inappropriate content sharing. The supervising adult must provide access links and permissions for Fizzics Education presenters in advance. 4.3 Platform Limitations If the chosen platform does not meet the necessary security and engagement features: The client accepts responsibility for any security breaches or violations, including those relating to the Enhancing Online Safety for Children Act 2015. Fizzics Education may need to modify the advertised program format to accommodate the platform’s limitations. 5. Cybersecurity and Privacy Supervising adults are responsible for ensuring that participant communication during the session remains safe and appropriate. Fizzics Education will take all reasonable steps to ensure a secure session but is not liable for incidents that occur due to third-party platform deficiencies or insufficient participant supervision. 6. Session Requirements The supervising adult is responsible for setting up the virtual conferencing space to meet the needs of the workshop or presentation (e.g., correct capacity, stable internet connection, and permissions for presenters). The supervising adult must also troubleshoot technical issues related to the chosen platform. 7. Modifications to Program Delivery If technical limitations or security concerns arise, Fizzics Education reserves the right to adjust the session format to ensure participant safety and engagement. 8. Governing Law This policy is governed by the laws of New South Wales, Australia. 9. Entire Agreement This policy constitutes the entire agreement regarding the delivery of online classes by Fizzics Education and supersedes any prior agreements or understandings. By booking an online class, you agree to the terms outlined in this policy.
